CM MARKETPLACE RETURN POLICY
Effective Date: April 11, 2026
1. ALL SALES ARE FINAL
All transactions on the CM Marketplace are final. Once an order has been fulfilled and shipped by the Seller, the Buyer may not return, exchange, or seek a refund for any raw materials purchased. By placing an order on the CM Marketplace, you acknowledge and agree to this no-return policy.
Raw materials require strict handling, storage, and chain-of-custody controls to ensure quality and safety. Because the Company cannot verify the condition of materials once they leave the Seller’s or the Company’s fulfillment facility, returns cannot be accepted.
2. EXCEPTIONS
The no-return policy does not apply in the following limited circumstances:
2.1 Materially Non-Conforming Product
The raw material received is materially different from the product described in the listing, including incorrect INCI name, wrong material entirely, or significant deviation from the stated specifications.
2.2 Damaged in Transit
The raw material arrived damaged, leaking, or in a compromised container due to shipping mishandling. Buyers must photograph the damaged packaging and product upon receipt as evidence.
2.3 Expired or Adulterated Product
The raw material received is expired (past its stated shelf life or expiration date at the time of delivery) or is adulterated, contaminated, or otherwise unfit for its intended use in cosmetic formulation.
2.4 Counterfeit or Misbranded Product
The raw material is counterfeit, misbranded, or misrepresented as to its origin, manufacturer, or composition.
3. DISPUTE FILING PROCESS
3.1 Timeframe
Buyers must file a dispute within seven (7) calendar days of confirmed delivery. Disputes filed after this window will not be reviewed.
3.2 Required Documentation
All disputes must include the following:
- Order number and date of delivery.
- A clear description of the issue.
- Photographic evidence of the product and packaging as received.
- The Certificate of Analysis (COA) from the listing compared to the product received, if applicable.
- Any other supporting documentation (e.g., third-party lab results).
3.3 How to File
Disputes must be submitted through the CM Marketplace dispute resolution portal within your account dashboard, or by emailing hello@cmstudioplus.com with the subject line “Marketplace Dispute — [Order Number].”
4. INVESTIGATION AND RESOLUTION
4.1 Review Period
The Company will review all disputes within ten (10) business days of receipt of a complete dispute submission. The Company may request additional information or documentation from either the Buyer or the Seller during the review.
4.2 Resolution Options
If the Company determines, at its sole discretion, that the dispute is valid, the following remedies may be offered:
- Full refund of the purchase price (excluding original shipping costs, unless the error was the Seller’s).
- Platform credit for the full purchase amount, usable toward any future CM Marketplace purchase.
- Replacement shipment from the Seller, if the Seller agrees and has available stock.
4.3 Seller Accountability
If a dispute is resolved in the Buyer’s favor, the Seller’s account will be noted accordingly. Repeated valid disputes against a Seller will result in the escalating penalties described in the CM Studio+ Terms and Conditions, Section 6.3, up to and including permanent account suspension.
4.4 Denial of Dispute
If the Company determines that the dispute is not valid — for example, if the product matches its listing description and arrived undamaged — the dispute will be denied and the original no-return policy will apply. The Company’s decision is final.
5. CHARGEBACKS
Buyers who file a chargeback or payment dispute with their bank or credit card provider for a legitimately fulfilled order, instead of using the dispute process described above, are in violation of the CM Studio+ Terms and Conditions. In such cases:
- The Buyer remains fully liable for the transaction amount, chargeback fees, and the Company’s costs of investigation and collection.
- The Buyer’s account will be immediately suspended.
- The Company reserves the right to pursue all available legal remedies, including civil litigation and referral to collections.
- Fraudulent chargebacks may be reported to law enforcement authorities.
Buyers are strongly encouraged to use the Platform’s dispute process before contacting their payment provider.
6. MANAGED FULFILLMENT ORDERS
For orders fulfilled through the Company’s Miami downpacking and fulfillment facility, the same no-return policy applies. However, because the Company handles storage and shipping for these orders, disputes related to shipping damage on managed fulfillment orders will be handled directly by the Company, and resolution may be expedited.
7. PRODUCT QUALITY DISCLAIMER
The Company does not manufacture, test, or independently verify the quality or composition of raw materials listed by Sellers on the CM Marketplace, except for a visual inspection of materials received at the managed fulfillment facility. Buyers are responsible for conducting their own quality control testing, including verifying Certificates of Analysis, before incorporating any purchased raw materials into their formulations or manufacturing processes.
